1. Introduction

Welcome to LexUp.

These Terms of Service ("Terms") govern your access to and use of the LexUp mobile application, website, content, features, subscriptions, and related services collectively referred to as the "Service."

LexUp is an English vocabulary learning application that provides interactive learning games, vocabulary practice, progress tracking, rankings, achievements, and optional premium features.

By downloading, accessing, creating an account, purchasing a subscription, or using LexUp, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Service.

3. Eligibility

You must be at least 13 years old to use LexUp.

If you are under the legal age of majority in your country, state, or region, you may use the Service only with the permission and supervision of a parent or legal guardian.

By using LexUp, you confirm that you meet the applicable age requirement and have the legal capacity or required permission to agree to these Terms.

4. Account Registration and Security

Some features of LexUp may require you to create an account or sign in using supported authentication methods, such as Google or Facebook login.

You agree to provide accurate and lawful information when creating or using your account.

You are responsible for:

• Keeping your account secure
• Maintaining control over your login credentials
• All activity that occurs under your account
• Promptly notifying us of unauthorized access or suspicious activity

We are not responsible for losses resulting from unauthorized access to your account caused by your failure to protect your login credentials.

5. License to Use the Service

Subject to your compliance with these Terms, LexUp grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, access, and use the Service for personal, non-commercial purposes.

This license does not give you ownership of LexUp, its content, software, design, database, learning materials, trademarks, or intellectual property.

You may not:

• Copy, modify, distribute, sell, lease, sublicense, or commercially exploit the Service
• Reverse engineer, decompile, disassemble, or attempt to extract the source code
• Use the Service to create a competing product or service
• Access the Service through unauthorized tools, scripts, bots, or automated systems
• Remove, obscure, or alter copyright, trademark, or proprietary notices
• Use LexUp in any unlawful, harmful, abusive, or unauthorized manner

6. User Nicknames and Public Profile Features

LexUp may allow you to choose a nickname and optional profile photo.

Your nickname, optional profile photo, score, ranking, level, achievements, or other gameplay-related statistics may be visible in certain areas of the Service, including leaderboards, rankings, and competitive game screens.

You agree not to use nicknames, profile photos, or public-facing information that:

• Is offensive, abusive, hateful, discriminatory, obscene, or harassing
• Impersonates another person, brand, company, or public figure
• Violates intellectual property, privacy, or publicity rights
• Promotes illegal activity, violence, self-harm, or exploitation
• Contains spam, advertising, misleading claims, or malicious content
• Is otherwise inappropriate for an educational application

We reserve the right to remove, modify, restrict, or reject any nickname, profile image, or public-facing content at our sole discretion.

7. User Conduct

You agree to use LexUp fairly, lawfully, and respectfully.

You must not:

• Use bots, scripts, auto-clickers, emulators, hacks, exploits, or unauthorized automation
• Manipulate scores, rankings, Elo ratings, rewards, achievements, or leaderboards
• Abuse bugs, vulnerabilities, or technical errors
• Attempt to gain unauthorized access to accounts, systems, databases, or servers
• Interfere with the operation, security, performance, or integrity of the Service
• Upload or transmit viruses, malware, harmful code, or disruptive content
• Harass, threaten, abuse, or impersonate others
• Use the Service for illegal, fraudulent, harmful, or unauthorized purposes
• Circumvent subscription, payment, advertising, reward, or security systems
• Violate applicable laws, regulations, or third-party rights

Violation of these rules may result in temporary or permanent account suspension, removal from leaderboards, loss of progress, cancellation of access to certain features, or termination of your account.

8. No Messaging or Chat Features

LexUp does not provide private messaging, public chat rooms, direct user-to-user messaging, or social posting features.

User interaction is limited to gameplay-related features such as rankings, leaderboards, competitive screens, nickname display, optional profile photo display, and game statistics.

This limitation is designed to support a safer educational environment.

9. Learning Content and Educational Purpose

LexUp is designed for educational and entertainment purposes.

Although we work to provide accurate, useful, and carefully reviewed vocabulary learning content, we do not guarantee that every word level, question, translation, explanation, ranking, or learning result will be completely accurate, complete, or suitable for every user.

LexUp does not guarantee any specific exam score, language proficiency level, academic result, employment outcome, visa result, or educational achievement.

Your progress depends on many factors, including consistency, prior knowledge, learning method, and individual effort.

10. Premium Subscriptions and Paid Features

LexUp may offer optional premium subscriptions or paid features.

Purchases and subscriptions are processed through Google Play Billing or another applicable app store payment system.

We do not directly collect or store your credit card, bank account, or full payment details.

Subscription terms, price, renewal period, trial availability, cancellation options, and billing details are displayed before purchase through the applicable app store.

By purchasing a subscription, you agree to the payment, renewal, and cancellation terms presented at the time of purchase.

11. Subscription Renewal and Cancellation

Subscriptions may automatically renew unless canceled before the renewal date, according to Google Play or the applicable app store's rules.

You are responsible for managing and canceling your subscription through your Google Play account or the applicable app store account.

Uninstalling or deleting the LexUp app from your device does not automatically cancel your subscription.

You can usually manage or cancel your subscription through:

• Google Play > Payments & subscriptions > Subscriptions

After cancellation, you may continue to access premium features until the end of the current paid billing period, unless otherwise stated by the applicable app store.

12. Refunds

Payments, refunds, cancellations, and billing issues are generally handled by Google Play or the applicable app store.

Refund eligibility may depend on the app store's policies, your location, the type of purchase, the time since purchase, and other applicable rules.

LexUp does not guarantee refunds unless required by applicable law or app store policy.

For refund requests, users should follow the refund process provided by Google Play or the applicable app store.

Where legally required or technically possible, LexUp may assist with purchase verification or support-related issues.

13. Advertising and Rewards

LexUp may display advertisements in the free version of the Service.

Ads may be provided by third-party advertising partners such as Google AdMob, AppLovin, Liftoff Monetize / Vungle, or similar providers.

Some ads may be optional rewarded ads, where users can choose to watch an advertisement in exchange for in-app rewards such as coins, boosts, continues, or other benefits.

Reward availability, reward amount, ad frequency, ad format, and ad eligibility may change at any time.

We do not guarantee that ads or rewards will always be available.

Attempting to manipulate, fake, automate, or abuse ad views, rewards, or advertising systems is strictly prohibited and may result in account suspension or loss of rewards.

14. Third-Party Services

LexUp may integrate or rely on third-party services, including but not limited to:

• Google Firebase
• Google Play Services
• Google Play Billing
• Google AdMob
• AppLovin
• Liftoff Monetize / Vungle
• Meta / Facebook Login
• Google Login

These third-party services may have their own terms, policies, privacy practices, and technical requirements.

By using LexUp, you acknowledge that your use of certain features may also be subject to third-party terms and policies.

We are not responsible for third-party services, ads, content, websites, systems, outages, payment processing, login systems, or policies.

15. Intellectual Property Rights

All rights, title, and interest in and to LexUp are owned by LexUp or its licensors.

This includes, but is not limited to:

• App design and interface
• Logos, icons, branding, and trademarks
• Text, graphics, images, illustrations, and visual elements
• Vocabulary content, questions, game structures, and learning materials
• Software, source code, object code, databases, algorithms, and systems
• Rankings, scoring systems, game mechanics, and progression systems
• Website content and documentation

You may not copy, reproduce, modify, distribute, sell, license, publish, display, transmit, scrape, extract, or create derivative works from any part of the Service without prior written permission from LexUp.

16. User Feedback

If you submit feedback, suggestions, ideas, bug reports, feature requests, reviews, or other comments about LexUp, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable right to use, modify, publish, implement, and incorporate that feedback without restriction or compensation to you.

This helps us improve the Service for all users.

17. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate your access to LexUp at any time if we reasonably believe that:

• You violated these Terms
• You abused the Service or other users
• You manipulated rankings, rewards, subscriptions, or app systems
• You used bots, hacks, exploits, or unauthorized tools
• Your nickname, profile photo, or activity is inappropriate
• Your account creates legal, security, fraud, or operational risk
• We are required to do so by law or platform policy

We may also remove or reset rankings, points, rewards, achievements, or progress if we determine they were earned unfairly or through abuse.

Upon termination, your right to use the Service will immediately stop.

18. Service Availability and Changes

We may update, modify, suspend, limit, or discontinue any part of the Service at any time.

This includes changes to:

• Features
• Game modes
• Rewards
• Prices
• Premium benefits
• Advertisements
• Rankings
• Content
• Compatibility
• Availability by region or device

We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device or operating system.

19. Updates and Compatibility

LexUp may require updates to continue functioning properly.

You are responsible for installing updates and using a compatible device, operating system, and app version.

Older versions of the app may stop working or may not include the latest features, security improvements, or bug fixes.

20. Privacy

Your use of LexUp is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, share, store, and protect personal information.

If the exact privacy URL changes, the most recent version will be made available through the app, website, or store listing.

21. Disclaimer of Warranties

To the maximum extent permitted by applicable law, LexUp is provided on an "as is" and "as available" basis.

We make no warranties, guarantees, or representations, express or implied, regarding:

• The accuracy, completeness, or reliability of content
• The availability, security, or performance of the Service
• The suitability of the Service for your needs
• The correction of errors or interruptions
• The absence of viruses, malware, or harmful components
• Any specific learning outcome, score, ranking, or result

You use the Service at your own risk.

Some jurisdictions do not allow certain warranty exclusions, so some of the above limitations may not apply to you.

22. Limitation of Liability

To the maximum extent permitted by applicable law, LexUp, its owners, developers, affiliates, service providers, and partners will not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or similar damages arising out of or related to your use of the Service.

This includes, but is not limited to:

• Loss of data
• Loss of progress
• Loss of rewards
• Loss of rankings
• Loss of subscription access due to platform issues
• Device issues
• Service interruptions
• Unauthorized account access
• Third-party service failures
• Advertising or payment issues
• Educational, exam, or learning outcomes

To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to LexUp for the Service in the twelve months before the claim arose, or, if you paid nothing, the minimum amount permitted by applicable law.

Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply to you.

23. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless LexUp, its owners, developers, affiliates, service providers, and partners from and against any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any law or third-party right
• Your nickname, profile photo, feedback, or public-facing information
• Fraud, abuse, cheating, automation, or unauthorized activity connected to your account

24. App Store Terms

If you download LexUp through Google Play or another app store, your use of the Service may also be subject to that app store's terms, policies, and payment rules.

In the event of a conflict between these Terms and mandatory app store terms, the applicable app store terms may apply to the extent required.

Google Play and other app stores are not responsible for providing support for LexUp unless required by their own policies or applicable law.

25. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last Updated" date at the top of this page.

If changes are material, we may provide additional notice through the app, website, store listing, or other reasonable means where required by law.

Your continued use of the Service after the updated Terms become effective means that you accept the revised Terms.

If you do not agree to the updated Terms, you must stop using the Service.

26. Governing Law

These Terms are governed by the laws of the Republic of Turkiye, unless mandatory consumer protection laws in your country, state, or region require otherwise.

Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.

27. Dispute Resolution

If you have a concern or dispute, please contact us first so we can try to resolve the issue informally.

If a dispute cannot be resolved informally, it will be handled according to the applicable laws and courts, unless mandatory consumer protection laws provide otherwise.

28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.

The invalid or unenforceable provision will be interpreted or replaced in a way that most closely reflects the original intent while remaining legally valid.

29. No Waiver

Our failure to enforce any part of these Terms does not mean that we waive our right to enforce it later.

30. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented inside the Service, constitute the entire agreement between you and LexUp regarding your use of the Service.
